Informed Consent, Waiver, and Release of Liability

This Informed Consent and Release of Liability Agreement ("Agreement") is entered into

by and between the undersigned Participant (or Participant’s Parent/Guardian, if under

18) and Deliberate Training LLC d/b/a Gravity Performance (“Gravity Performance, ” “we, ” “us, ” or “our”).

1. Acknowledgment of Risks

I understand that participation in personal training, physical exercise, sports performance, and

related activities involves inherent risks. These risks include, but are not limited to:

● Muscle strains, sprains, or tears

● Joint injuries

● Cardiovascular complications (e.g., heart attack, stroke, abnormal blood pressure)

● Dizziness, fainting, or loss of consciousness

● In rare cases, paralysis or death

I further understand these risks may arise from the ordinary negligence of Gravity Performance

or its employees, contractors, agents, officers, or owners (collectively, the “Releasees”), or from

my own actions or conditions.

2. Voluntary Participation & Medical Responsibility

I confirm that:

● My participation is voluntary and at my own risk.

● I have disclosed all relevant medical history, conditions, and current medications.

● I may be required to complete a fitness assessment and/or provide a physician’s clearance before participating.

● I agree to stop exercising and inform my instructor immediately if I experience any discomfort, pain, shortness of breath, dizziness, or other concerning symptoms.

3. Instructions & Physical Contact

I agree to follow all instructions given by my instructor or coach. I understand that physical touch

or adjustments may be necessary to ensure proper form and alignment. I consent to appropriate

physical contact for these purposes.

4. Waiver and Release of Liability

In consideration of my participation, I hereby waive, release, and forever discharge the

Releasees from any and all claims, liabilities, demands, or causes of action arising out of any

personal injury, disability, property damage, or death I may suffer, including those caused by the

ordinary negligence of the Releasees.

This waiver does not apply to gross negligence, willful misconduct, or intentional harm.

5. Indemnification

I agree to indemnify and hold harmless the Releasees from any claims, costs, or damages

(including attorney’s fees) arising out of my participation in the activities, including any claims

brought by third parties or by me after the date of this Agreement.

6. Emergency Medical Authorization

In the event of an emergency, I authorize Gravity Performance and its representatives to secure

necessary medical care on my behalf. I agree to be financially responsible for any resulting

expenses.

7. Media Release (Optional but Recommended)

I grant permission for Gravity Performance to capture and use photos, video, or audio

recordings of me for promotional, marketing, or educational purposes. I understand that no

compensation will be provided.

8. Dispute Resolution

I agree that any dispute arising from this Agreement will first be resolved through good faith

mediation. If unresolved, it will be submitted to binding arbitration in Vanderburgh County,

Indiana, under the rules of the American Arbitration Association.

9. Governing Law

This Agreement shall be governed and interpreted under the laws of the State of Indiana.

10. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions

shall remain in full force and effect.

11. Minors – Parental Consent & Indemnification

(If participant is under 18 years old)

As the legal guardian of the minor named below, I give my permission for their participation and

agree to the terms above. I also agree to indemnify and hold harmless Gravity Performance

from any claims or lawsuits brought by or on behalf of the minor, including claims asserted after

they reach the age of majority.
